.—Today, Representatives Ami Bera, M.D. (D-CA), Tony Cárdenas (D-CA), Mike Kelly (R-PA), Ron Kind (D-WI), Roger Marshall, M.D. (R-KS), Markwayne Mullin (R-OK), and Brad Wenstrup, D.P.M. (R-OH) released the following statement in response to final rulemaking released Friday by the Trump Administration to modernize the Stark and Anti-Kickback statutes that work to prevent health care fraud and abuse:

"As Members of Congress committed to moving our health care system toward one that rewards value over volume, we are pleased these rules improving the Stark and Anti-Kickback statutes were recently finalized, creating new pathways to allow value-based partnerships that don't increase the risk of fraud and abuse to the system.

However, we remain concerned that the rules exclude certain entities from participating in these arrangements. We believe that as long as arrangements demonstrate that stakeholders are partnering for the purpose of improving patient care and demonstrate clear outcomes that patients are healthier for it, all entities should be able to participate. Our health care system would become more efficient when incentives align for as many stakeholders as possible to deliver ideal care for the patient. We look forward to working in Congress to continue modernizing these laws and move our health care system into the 21^st century."

Reps. Bera, Cárdenas, Kelly, Kind, Marshall, Mullin, and Wenstrup recently urged the Trump Administration to finalize rules modernizing the Stark and Anti-Kickback laws.
